Judge rules Sunchaser Villas resort has right to charge renovation fee

A B.C. Supreme Court judge has ruled that a timeshare resort in Fairmont, B.C. has the right to charge owners and lease-holders a hefty renovation fee, over and above their annual maintenance fee.  It also has the right to charge a cancellation fee to those who want to surrender their stake in the resort to get out of paying for the renovation.

The decision affects roughly 14,000 owners who live across Western Canada and the U.S., including many in Saskatchewan.

It means bills averaging about $4,000 will be going out to people who own or lease timeshare units at Sunchaser Vacation Villas.

The resort says so far, about a quarter of the owners and lease-holders have enrolled in a monthly payment plan to pay for the renovation, while another quarter have opted for the cancellation fee.

Meanwhile, lawyers for 655 owners say they will take the case to the B.C. Court of Appeal.
